Michigan explores extending statute for sexual assault – but is justice really the goal

Michigan lawmakers are currently deliberating a bill that proposes to extend the statute of limitations for sexual assault survivors. According to supporters, this change would give survivors more time to seek justice, but some are wary of its drawbacks.

Those in favor believe that the extended time frame for filing a civil lawsuit (nearly double the current three-year limit) and the age limit raise from 28 to 48 would empower survivors. They argue that survivors often need time to process trauma before being able to seek legal recourse. Moreover, it would give them more time to come forward without fear of being excluded due to elapsed time.

Yet, critics are skeptical about the potential consequences of such an expansion. They express concern that the changes might make it harder for victims to file criminal complaints. Extending the statute of limitations could lead to an increase in false claims or offer offenders a lenient provision. Some also worry that critical evidence could be lost over time, making it difficult to prove a case and potentially wrongfully accusing someone.

In my opinion, either way, it is a slippery slope: in extending the statutes, it would essentially enable offenders to take advantage and continue harming others by offering no significant deterrence, but not allowing survivors enough time to come forward can be equally problematic. A more mediated approach, perhaps, allowing more time for survivors to process trauma but reducing the maximum age limit to file civil suits, could be an effective compromise. However, lawmakers must weigh in all arguments and make a sound decision that supports justice for all parties involved.
