Judge Rejects Michael Cohen’s Plea for Early Release Due to COVID-19 Was it the Right Call

In the midst of the COVID-19 pandemic, concerns about the health and safety of those incarcerated in prisons have come to the forefront. Michael Cohen, former personal attorney to President Donald Trump, brought forward one such concern when he petitioned for early release from Otisville federal prison. But was the judge’s decision to deny his request justified?

Firstly, Cohen’s pre-existing medical conditions do put him at higher risk for contracting the virus, and prisons have been identified as high-risk areas for the spread of COVID-19. It’s understandable that he would want to protect himself from potential harm and discomfort. However, on the other hand, the judge made a valid point that the prison has taken necessary precautions, such as social distancing and providing PPE, to keep inmates safe.

Furthermore, as the judge emphasized, taking into account the current risks, releasing prisoners early could significantly increase the spread of the virus among the general public at large. It’s undoubtedly critical to hold people accountable for their actions, which can be hindered when early release is granted just on the basis of the pandemic. At the same time, people’s health and safety should not be compromised in the process.

This issue is undoubtedly complex and has no easy solution. Firstly, people like Cohen should not be exposed to undue risk in times of a pandemic. Yet, rules exist for good reason, and society cannot afford to have prisoners be released early, for just a perceived, albeit possible decrease in the exposure to COVID-19. Perhaps the solution lies in finding a balance between the two, providing inmates with necessary precautions, and keeping the public safe. The decision of the judge reflects the need for a nuanced and case-by-case approach.
