Jolting Subway Death Was it Murder or Self-defense

The tragic death of Jordan Neely on a New York City subway train has sparked a debate about whether the accused, Daniel Penny, should be charged with murder or manslaughter. According to court documents, the two men were involved in a physical altercation that led to Penny using a chokehold on Neely, causing him to pass out and ultimately die.

One side argues that Neely’s death was a tragic accident and that Penny acted in self-defense. They point to the fact that Neely allegedly spat on Penny, which could be seen as a provocation. Therefore, Penny was simply defending himself and should not be held responsible for the victim’s death.

On the other side, the prosecution portrays Penny as the aggressor who intentionally caused Neely’s death. They point to the fact that Penny used a potentially deadly chokehold and that there were other ways to subdue Neely. They argue that Penny’s actions were not self-defense and that he should be held accountable for Neely’s untimely demise.

In my opinion, it is difficult to determine definitively which side is correct without knowing all the facts. While it is understandable that Penny may have felt threatened and acted impulsively, his decision to use such a dangerous move like a chokehold is questionable. At the same time, it is also true that Neely’s alleged spitting could have provoked a reaction from Penny without intending to cause his death.

Regardless of whether one believes that Penny’s action was brought on by self-defense or malevolent intent, the fact remains that someone died in a senseless act of violence. What must be done now is to allow the court to fulfill its duty of determining the truth and delivering proper justice.
