Could the Biden Administration’s Use of Title 42 be Violating Human Rights at the Southern Border

The use of Title 42 has undoubtedly led to a significant reduction in the number of apprehended migrants at the southern border. However, it is crucial to consider whether it violates human rights and discriminates against vulnerable populations.

Firstly, the Biden administration argues that Title 42 is a necessary public health measure to prevent the spread of COVID-19 at the southern border. The decrease in apprehended migrants does suggest that it has been effective in achieving this goal. Additionally, those who are expelled under Title 42 are provided with information on how to apply for asylum and receive medical screenings to ensure they do not have COVID-19 before returning to their home countries.

Alternatively, various advocacy groups and human rights organizations argue that Title 42 is discriminatory and violates the rights of asylum seekers. There are concerns that vulnerable populations, such as unaccompanied minors and those fleeing persecution in their home countries, are being expelled from the United States, which is an infringement of US and international law. Moreover, there have been reports of individuals being expelled to countries where they could face harm and danger.

In my opinion, while Title 42 may have been an effective public health measure, it is essential to ensure that it is not a violation of human rights. The United States has a long history of providing refuge to those fleeing persecution and danger in their home countries. If this policy is infringing on that right, it needs to be reevaluated. At the same time, it is vital to find a balance between public health measures and the protection of human rights. Anything less would be a disservice to the values of this great country.
